If a student loan that was already forgiven is still showing up as an active balance with the credit bureaus, there’s a direct process for challenging it — though a pending lawsuit suggests it isn’t always working the way it should.

Steps to dispute the error

  1. Get your credit reports from Equifax, Experian, and TransUnion and confirm the discharged loan appears on each one — a lawsuit filed against the Department of Education alleges the same canceled balances have been reported to all three.
  2. Gather your discharge paperwork — the notice or letter confirming your loan was forgiven, ideally with the date of discharge.
  3. File a dispute separately with each bureau reporting the balance, including a copy of your discharge documentation as supporting evidence.
  4. Notify your loan servicer and the Department of Education directly, since they’re the source feeding the bureaus the (incorrect) information.
  5. Document everything — save confirmation numbers, submission dates, and any written responses in case you need them later.

Why disputes alone may not fix it

The lawsuit, Woods v. U.S. Department of Education, argues the Department continued reporting canceled balances as active for years after forgiveness — one named plaintiff, Marine veteran Jorge Cortes, still had a $21,586 balance on his credit report this summer despite his ITT Technical Institute loans being discharged back in August 2022. That’s part of why the case exists: standard disputes don’t appear to have resolved this for a large group of borrowers, which is why the suit is seeking class-action status for more than 300,000 people whose loans were discharged between April 2022 and January 2025.

What’s next

The case is pending in the U.S. District Court for the District of Columbia, and the Department of Education had not responded to a request for comment as of the report. If your dispute doesn’t resolve the issue, it’s worth keeping an eye on how this lawsuit develops — it may end up shaping how this gets fixed beyond an individual dispute.
